Terms of Use (EULA)

Welcome to XMuscles. This End User License Agreement ("Agreement" or "Terms") is a legal agreement between you and XMuscles ("we", "us", or "our") governing your use of the XMuscles mobile application ("App") available on Apple's App Store. By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, subject to this Agreement and the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features of the App, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Auto-Renewable Subscriptions

4.1 Subscription Plans

XMuscles offers a free tier with limited features and the following auto-renewable subscription plans that unlock premium ("Pro") features:

  • XMuscles Pro Monthly — auto-renewable subscription billed monthly. The subscription renews every 1 month.
  • XMuscles Pro Annual — auto-renewable subscription billed annually. The subscription renews every 12 months.

Current subscription prices are displayed in the App at the time of purchase and may vary by region. Prices are set in App Store Connect and are subject to change.

4.2 Pro Features

A Pro subscription unlocks the following premium features:

  • AI Workout Coach — personalized workout generation via chat
  • AI Workout Plan Generator — multi-day training plans
  • Progressive Overload Suggestions — smart weight/rep recommendations
  • Advanced Workout Analytics — trends, muscle radar charts, exercise stats
  • Unlimited Custom Workouts — create and save unlimited templates
  • Body Intelligence LAB Full Access — recovery suggestions, weekly reports
  • AI Body Scan — body composition analysis from photos
  • Offline Cache — download workout data for offline use

4.3 Free Trial

We may offer a free trial period for new subscribers. The free trial duration is displayed in the App at the time of signup. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the price displayed at the time of purchase. Free trial eligibility is determined by Apple and is generally available only once per Apple ID.

4.4 Billing and Renewal

Payment is charged to your Apple ID account at confirmation of purchase (or at the end of the free trial period, if applicable). Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the subscription price displayed at the time of renewal.

4.5 Managing and Cancelling Subscriptions

You may manage or cancel your subscription at any time through your Apple ID account settings:

  1. Open the Settings app on your iPhone
  2. Tap your Apple ID (your name at the top)
  3. Tap Subscriptions
  4. Select XMuscles Pro
  5. Tap Cancel Subscription

Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until the end of the period you have already paid for. No partial refunds are provided for the unused portion of a subscription period.

4.6 Refunds

All subscription payments are processed by Apple. Refund requests must be directed to Apple in accordance with their refund policies. Visit Apple Support — Request a refund for more information.

4.7 Price Changes

We reserve the right to change subscription prices. If the price of a subscription increases, Apple will notify you and request your consent before the new price takes effect. If you do not consent, your subscription will not renew at the new price.

5. Use of the App

5.1 Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the App to transmit harmful or malicious content
  • Reproduce, distribute, or create derivative works of the App

5.2 User Content

You retain ownership of any content you submit through the App (such as workout notes or profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely for the purpose of providing and improving the App.

6. Health and Fitness Disclaimer

XMuscles is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The health metrics, recovery scores, Body Battery, AI recommendations, and other data provided by the App are for informational and educational purposes only. They should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always consult with a qualified healthcare provider before beginning any new exercise program, especially if you have pre-existing health conditions, injuries, or concerns. You use the App and follow its suggestions at your own risk.

7. Apple HealthKit Integration

The App integrates with Apple HealthKit to read and write health data (such as heart rate, sleep, workouts, and activity data). This data is used solely to provide personalized fitness insights within the App. We do not sell HealthKit data to third parties or use it for advertising purposes.

8. AI-Generated Content

The App uses artificial intelligence to generate workout plans, text recommendations, and body composition analysis. AI-generated content is provided as suggestions only and may contain inaccuracies. All metric values and scores are calculated using deterministic formulas — AI is used only for text explanations and recommendations.

9. Intellectual Property

The App, including its design, code, features, content, and branding, is the property of XMuscles and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately, and you must destroy all copies of the App in your possession. You may also delete your account at any time through the App's settings. Termination does not entitle you to a refund of any subscription fees already paid.

11. Limitation of Liability

To the maximum extent permitted by applicable law, XMuscles shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or loss of profits, arising out of or in connection with your use of the App.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

13. Third-Party Services

The App may contain links to or integrate with third-party services (including Apple HealthKit, Firebase, and AI providers). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk and subject to their respective terms.

14. Apple-Specific Terms

This Agreement is between you and XMuscles only, and not with Apple. Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

15. Privacy

Your use of the App is also governed by our Privacy Policy, available at www.x-muscles.com/privacy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

16. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will notify you of material changes by posting the updated Agreement in the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the revised Agreement.

17. Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
